However, and subject to compliance with certain conditions, this period may be exceeded. <a name=\"_Toc55231064\"><\/a><a name=\"_Toc55231089\"><\/a><a name=\"_Toc55231064\"><\/a><a name=\"_Toc55231089\"><\/a><\/p>\n<h1 style=\"text-align: justify;\"><span style=\"color: #000000;\"><strong><span style=\"font-size: xx-large;\">1.<u>The maximum daily working time<\/u><\/span><\/strong><\/span><\/h1>\n<p style=\"text-align: justify;\"><strong>In principle<\/strong>, the maximum daily working time may not exceed <span style=\"color: #e09900;\">10 hours.<\/span> This period also applies to interns.<\/p>\n<p style=\"text-align: justify;\">This duration is assessed in the context of the calendar day, which begins at 00:00 and ends at 24:00.<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #e09900;\">The maximum duration is understood in terms of actual work.<\/span><\/p>\n<p style=\"text-align: justify;\">However, derogations may be provided:<\/p>\n<ul style=\"text-align: justify;\">\n<li><span><span style=\"color: #0c71c3;\">Contractual derogations<\/span>:<\/span> by company or establishment agreement or, failing that, a branch agreement, in the event <strong>of increased activity or for reasons related to the organisation of the company. <\/strong>On the other hand, the daily working time must not be increased to <span style=\"color: #e09900;\">more than 12 hours.<\/span><\/li>\n<li><span style=\"color: #0c71c3;\">Administrative derogations<\/span>: by the labour inspector authorising the <strong>overrun in the event of an increase in activity <\/strong>in certain accepted cases <em>(for example, by work that must be carried out within a specified period due to its nature). <\/em>Beforehand, the employer must obtain the opinion of the CSE.<\/li>\n<li><span style=\"color: #0c71c3;\">Unilateral derogation by the employer: <\/span>in an <strong>emergency <\/strong>in cases admitted for labour inspection. To do this, the employer must submit a request for regularisation to the labour inspectorate accompanied by the opinion of the CSE.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\"><span style=\"text-decoration: underline;\"><span style=\"font-size: xx-large;\"><strong>2. The length of the working day\u00a0<\/strong><\/span><\/span><\/p>\n<p style=\"text-align: justify;\">The amplitude of the day corresponds to the period between <strong>the time the employee takes up his or her position<\/strong> and <strong>the time he or she leaves<\/strong>. Thus, the employer must respect the scope of work, the non-compliance giving rise to the right to <span style=\"color: #e09900;\"><u>damages for the employee<\/u>.<\/span><\/p>\n<p style=\"text-align: justify;\">Its duration is limited by the <strong>daily rest period of 11 hours.<\/strong> Thus, the daily working hours may not exceed <span style=\"color: #e09900;\">13 hours<\/span> (24 hours \u2013 11 hours = 13 hours).\u00a0<\/p>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\"><span style=\"text-decoration: underline;\"><span style=\"font-size: xx-large;\"><strong>3. The maximum weekly duration<\/strong><\/span><\/span><\/p>\n<ul style=\"text-align: justify;\"><\/ul>\n<p style=\"text-align: justify;\">While a duration of more than 35 hours is possible, it remains limited:<\/p>\n<ul style=\"text-align: justify;\">\n<li><span> <\/span>This duration may not exceed <span style=\"color: #e09900;\">48 hours<\/span> in the same week. However, if the labour inspectorate authorises it for exceptional circumstances, the duration may be extended to <span style=\"color: #e09900;\">a maximum of 60 hours.<\/span><\/li>\n<li>This duration may not exceed <span style=\"color: #e09900;\">44 hours <\/span>(46 hours in the case of a collective agreement) over any period of <strong>12 consecutive weeks<\/strong>. On the other hand, in the absence of a collective agreement, an overrun may be <strong>authorised by the DREETS <\/strong>provided that an average of <span style=\"color: #e09900;\">46 hours<\/span> over 12 weeks is respected. In addition, this limit of<span style=\"color: #e09900;\"> 46 hours<\/span> may be exceeded <strong>on an exceptional basis<\/strong> in certain <strong>sectors, regions or companies. <\/strong><\/li>\n<\/ul>\n<p style=\"text-align: justify;\">This maximum duration also applies to employees who hold several jobs.<\/p>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\"><span style=\"text-decoration: underline;\"><strong><span style=\"font-size: xx-large;\">4. The burden of proof of working hours<\/span><\/strong><\/span><span style=\"font-size: large; color: #0c71c3;\"><strong><\/strong><\/span><\/p>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">In principle, in a dispute relating to the existence or number of hours worked, the <strong>burden of proof is <u>shared<\/u><\/strong>.<\/p>\n<p style=\"text-align: justify;\">Thus, <span>the <span style=\"color: #e09900;\">employer<\/span><\/span> must provide the judge <span>with <span style=\"color: #e09900;\">the elements to justify the working hours worked<\/span><\/span> by the employee and, on the other hand, the <strong>employee<\/strong> must provide <strong>the elements to support his\/her request<\/strong>. In this sense, according to settled case-law, the proof of hours worked is not specifically incumbent on either party.<\/p>\n<p style=\"text-align: justify;\"><span><span style=\"color: #e09900;\">In the case of overtime<\/span>, <\/span>the burden of proof is equally <strong>shared between the employer and the employee<\/strong>. Thus, case law specifies that the employee cannot simply claim that he or she has worked overtime but must provide proof of what he or she claims <strong>by any means <\/strong>(time sheets, emails, diary, testimonies,&#8230;).<\/p>\n<p style=\"text-align: justify;\">However, a problem arises when these overtime hours are <span style=\"color: #e09900;\">tacitly accepted<\/span> by the employer.
